Terms of Use for ALF Connect

The Community Website Terms of Use (“Terms of Use”) are defining the conditions under which you may access and use the Community Website and all the functionalities provided (hereinafter designated together the “Service”).
By accessing or using the Service or by logging into with your allocated User ID, you agree to be bound by these Terms of Use. The User undertakes to have legal ability and means required to access and use the Service and acknowledges to have read, understood, and accepted without limitation or reservation the Terms of Use, which apply in addition to the Privacy Policy.
Please review these Terms of Service carefully prior to using the Service. If you do not agree with these Terms of Use, please do not use the Service.

Community Website: the online platform named ALF Connect, edited by Hivebrite and provided by American Leadership Forum, allowing User to benefit from the Service.
User Account: means a dedicated online account opened by any visitor and providing an access to the Service.
Identifiers: means login and password or social login the User used to create the User Account.
Party or Parties: means the User and American Leadership Forum designated either individually or collectively.
Service: means the Community Website and all the functionalities provided thereto and described in the Terms and Conditions.
Service Content: any data, text, files, information, usernames, images, graphics, photos, profiles, audio and video clips, sounds, works of authorship, applications, links, and other content or materials made available during the Service.
User or Users: means any person authorized by American Leadership Forum to access and use of the Service after creation of a User Account.
User Content: any content created, posted, or shared by the User, on or through the Service including any information, data, photos, and other content relating to the User.
The Terms of Service will come into effect on first access to the Service for the entire duration of use.
The Service enables Users to connect with each other, build communities, or also do networking.
The Service comprises a suite of online services provided by American Leadership Forum, allowing the User to:
These Terms of Service govern the use of each component of the Service.
Access to the Service shall be subject to the creation of a User Account.
The Service is available on the website at https://connect.alfnational.org or the mobile app ALF Connect that can be downloaded through the Apple App Store or Google Play Store.
The User must have (the “User’s System”):
Users shall bear all the costs for accessing the Service.
Option 1: The User shall confirm first name, last name, and email address, and choose a password.
Option 2: The User can create a User Account by connecting through his or her Apple/Facebook/Google account.
The User agrees to provide only accurate and complete information when creating or updating his/her Account information.
In order to benefit from the Services, the User must login using the Identifiers created in Option 1 of item 5.2 above or using his or her Apple/Facebook/Google account. Identifiers and Apple/Facebook/Google credentials are personal and confidential. Users are responsible for keeping these Identifiers and credentials secret and responsible for not disclosing these to any third party in any form and for any reason whatsoever.
The User’s login can only be changed at the request of the User or at the initiative of American Leadership Forum. The User’s password is modifiable by the User through the User’s Account. If the User forgets her/his password, the User can generate a new one by clicking on the link “Reset my password”.
The User is solely responsible for the activity that occurs on its User Account and will be responsible to keep its Identifiers secure and for the use of his/her Identifiers by third-parties or for any actions or declarations made through his/her User Account, whether fraudulent or not, and guarantees American Leadership Forum against any request in this respect.
If the User has reason to believe that a person is fraudulently using identification elements or her/his User Account, she/he must immediately inform American Leadership Forum by e-mail at [email protected].
The User is solely responsible for the improper access, damage, disruption, loss or theft and adverse consequences caused by its breach of the confidentiality of the Identifiers. In case of loss, misappropriation or unauthorized use of its password, the User shall immediately notify Amercian Leadership Forum.
Users may not use another’s account without permission. A User Account may not be shared, transferred, or sold to other parties, nor are they to be used by or made available to any person or entity except the registered user.
The Service is available for free of charge (excluding any connection costs, whose price depends on your electronic communication service provider) for Senior Fellows of ALF chapters in good standing.
Some Events listed on the Service may charge a fee for attendance.
The Service and the Service Content belong and shall remain the property of American Leadership Forum or its licensors as appropriate, and is protected by copyright, patent when applicable, trade secret and other intellectual property laws.
The User shall not acquire any of such rights of title and interest (including, without limitation, all intellectual property rights such as copies, modifications, extensions, and derivative works thereof) save as otherwise expressly set out in this Article 7.2 and the User shall take all necessary measures to this effect. All rights not expressly granted to Users are reserved and retained.
Any reproduction, representation, distribution, modification, adaptation, or translation of the Service Content, in whole or in part, in any form in current or future medium is strictly prohibited, except within the limit of these Terms of Use or with prior express authorization of American Leadership Forum. Any use of the Service Content not expressly authorized by American Leadership Forum shall constitute a violation of the Terms of Use and a violation of intellectual property rights.
Except as specifically permitted by these Terms of Use, User may not use or register any name, logo, brand, or insignia of American Leadership Forum or any of its chapters for any purpose except with American Leadership Forum’s prior written approval and in accordance with any restrictions required by American Leadership Forum.
Hivebrite is the producer of databases on the Community Website and American Leadership Forum is the owner of any databases made available. The User shall not extract or reuse a substantial qualitative or quantitative portion of the databases, including for private purpose.
American Leadership Forum grants the User a limited, non-exclusive, non-transferable, and revocable license to use the Service for User’s personal, non-commercial purposes. The User may only use the Community Website on devices that User owns or controls. User may use the Service and the Service Content only in the manner and for the purposes specified in these Terms of Use. Except as specifically permitted by these Terms of Use, User may not modify, transmit, produce, distribute, display, sell, license, broadcast, or otherwise make available in any form or by any means any part of the Service or the Service Content without the express written permission of American Leadership Forum.
In connection with the use of the Services and Service Content or User’s Content, the User is not authorized to, or cannot allow a third party to:
The User represents and warrants that she or he retains ownership of all of his intellectual property rights in the User Content or that this User Content is subject to a license granted to the User by a third party holding these rights, under conditions allowing the User to freely use and/or transfer these elements for the purpose of using the Service, under the conditions described in these Terms of Use. American Leadership Forum does not claim ownership of the User Content.
The User holds American Leadership Forum harmless from all claims or actions brought by third parties on the grounds of an infringement of their rights, including, without limitation, publicity rights, copyrights, trademark and/or other intellectual property rights or privacy rights in the User Content.
By using the Service, the User represents and warrants that she or he has the legal right and capacity to enter into these Terms of Use in the User’s jurisdiction.
User warrants to be at least 18 years of age or older or an emancipated minor, or possess legal parental or guardian consent, and is fully competent, to use the Service and to enter into and comply with these Terms of Use. If the User is under the age of 18 years, the User must obtain verifiable consent from a parent or legal guardian. The parent or legal guardian shall be able to provide consent to her or his child’s use of the Service and agree to be bound by these Terms of Use in respect to her or his child’s use of the Service. Persons aged 13 years old or less are not authorized to access the Service.
User may not post content which includes, but is not limited to: (i) sexually explicit materials; (ii) obscene, misleading, libelous, slanderous, violent, hateful and/or unlawful content or profanity; (iii) content that infringes upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary right, or that is deceptive or fraudulent; (iv) content that promotes the use or sale of illegal or regulated substances, tobacco products, ammunition and/or firearms; and (v) gambling, including without limitation, any online casino, sports books, bingo or poker via the Service.
User may not defame, stalk, bully, abuse, harass, threaten, impersonate, or intimidate people or entities and must not post private or confidential information via the Service, including, without limitation, the User or any other person's credit card information, social security or alternate national identity numbers, non-public phone numbers or non-public email addresses.
User must not create accounts with the Service through unauthorized means, including but not limited to, by using an automated device, script, bot, spider, crawler, or scraper. User must not attempt to restrict another User from using or enjoying the Service and must not encourage or facilitate violations of these Terms of Service.
Prohibited activities on the Service include, but are not limited to: (1) activities that are illegal or fraudulent; (2) use that inaccurately implies endorsement, approval, or sponsorship by American Leadership Forum (or any individual officer or employee of American Leadership Forum); (3) use that can be confused with official communications of American Leadership Forum or its officers or employees; and (4) print or electronic mass solicitations for commercial services.
In order to ensure the Community Website provides the best experience possible for everyone, if a User sees any inappropriate content, she or he must use the “Report as offensive” feature found under each post.
American Leadership Forum has no general obligation to monitor User Content nor to investigate whether facts or circumstances are revealing illicit activities. American Leadership Forum has set up a reporting tool allowing any User to notify illegal, abusive and harmful content.
The knowledge of such content is deemed effective when the hosting provider is notified of following:
If a User Content is reported, American Leadership Forum reserves the right to withdraw the reported content and/or suspend or terminate the User Account of the User having originally published the reported content in the conditions set forth in Article 11.2.
At any time, the User may delete his/her User Account by contacting American Leadership Forum at the address or email address mentioned in Article 15. Deletion is effective immediately and all the data collected upon the subscription as well as the content published by the User on the Community Website will be deleted.
American Leadership Forum retains the right to suspend User’s access to the Service to make all investigations necessary following a report made pursuant to Article 10 or in case of presumed breach of Terms of Use which may be remediated. The User whose User Account is suspended will be informed by American Leadership Forum of such a decision by email. The User may send an email to American Leadership Forum to obtain additional information on the reasons for the suspension as well as to provide explanations and/or any element in order to demonstrate that the reason(s) for suspension has been remediated. If the violation of Terms of Use is not remedied within one (1) month from suspension notification, American Leadership Forum reserves the right to terminate the applicable User’s Account and right to use the Service, in addition to any other rights or remedies available.
By using the Service, User’s personal data may be collected and processed by American Leadership Forum in compliance with the American Leadership Forum’s Privacy Policy.
American Leadership Forum will treat User Content as confidential information in accordance with these Terms of Use and the Privacy Policy.
American Leadership Forum is not responsible for the User’s device compatibility nor if the User is unable to connect due to any technical problem related to the Internet network or a failure in the User's computer facilities and equipment.
American Leadership Forum shall not be responsible for User’s System nor any problems arising from or related to User’s System or caused by the Internet. User is responsible for the security of the User System and the security of its access to and connection with the Services.
Insofar as it has not been reported in the conditions of Article 10, any document, information, data, or elements available via the Service, including User Content (“Information”) is provided without any guarantees, notably that the Information is comprehensive or accurate.
The User is solely responsible for the use of the Information and bears all the risks arising from your reliance on this Information. The Information is provided on the condition that the User can determine its interest for a specific purpose before use. Under no circumstances will American Leadership Forum accept liability for injury arising from reliance on the said Information, its use or use of a product to which it refers.
The User is solely responsible for all User Content posted and assumes all risks relating to its use by others and others’ reliance on its accuracy. The User acknowledges that, following the publication of any content on the Service, its information will become accessible to all the Users on the Community Website. American Leadership Forum will have no responsibility or liability in connection with the User Content.
American Leadership Forum expressly excludes any liability for events of any kind that may occur during any meeting organized between Users within the use of the Services.
The Community Website may provide links to websites operated by third parties or other internet sources/networks, as well as data/information coming from third-party servers. American Leadership Forum does not endorse or accept responsibility for the content or the use of third-party websites and cannot be held liable for any damage following or in relation with use or the fact of having trusted the content/data/results available on such third-party servers, external sources or internet sites.
If a User uses third-party sites or content from third-party servers, User does so solely at User’s own risk. Links do not imply that the Company is affiliated or associated with any linked site.

Governing Law and jurisdiction. These Terms of Use will be governed by the laws of California, USA.
Change of Terms of Use. These Terms of Use are subject to change from time to time. Users will be notified and required to agree to any changes to these Terms of Use. Use of this Service or any Service Content after agreeing to the new version of the Terms of Use will constitute the agreement to the modified Terms of Use. If the User disagrees with such modification of the Terms of Use, the User may terminate the Service and delete its User Account under the conditions set forth in Article 11.
Change of the Service. American Leadership Forum may further develop or modify the Service or the Service Content only to improve its quality. The User will be informed of such development/modification as soon as it is implemented.
Severability; Entire Agreement. Except in the case of invalidity of an essential clause, if any provision of these Terms of Use is held to be invalid or unenforceable, that provision, to the extent unenforceable, shall be struck, and shall not affect the validity or enforceability of the remaining provisions. These Terms of Use, including the Privacy Policy, set forth the entire understanding and agreement between the User and American Leadership Forum with respect to the subject matter hereof.
Convention of proof. Electronic documents exchanged by electronic means between the User and American Leadership Forum shall be regarded as writings having the same probative force as writings on paper in the meaning of applicable law. They may constitute faithful and durable copies in accordance with applicable law, so that the User is invited to keep them.
Force majeure. In no case American Leadership Forum may be held liable for any breach of its contractual obligations resulting from a force majeure event as defined in applicable law and related jurisprudence.

We will not sell, share, or trade our members’ names or personal information with any other entity, nor send mailings to our members on behalf of other organizations. This policy applies to all information received by American Leadership Forum (ALF) on ALF Connect and other online and offline sources listed below. This policy also covers use of all information for marketing-related communications.
Your privacy is a priority for American Leadership Forum, and we want you to be familiar with how we collect, use, and disclose information relating to you, your computer, or your device and that enable your identification (“Personal Information”). This Privacy Policy describes our practices with information that we (or our service providers) collect from a user (sometimes referred to as “you” or “your”) through our websites, applications, and our other network-connected products and services that link to this Privacy Policy (collectively, the “Site”).
This Privacy Policy only addresses information collected directly through or from our Site – it does not address or govern any information-gathering, use, or dissemination practices related to information collected from you other than directly through or from the Site, such as from telephone, facsimile, postal mail, personal delivery, or other or additional offline means or media. 1. Collection of Personal Information from Users
When you interact with us through the Site, we may collect information from you as described in this Privacy Policy.
a. Information You Provide
Some elements of the Site may ask you to submit Personal Information in order for you to benefit from the specified features or participate in a certain activity, such as newsletter subscriptions or donation processing. For example, if you register for an account on the Site, we may request Personal Information such as your name and contact information. If you make a donation on the Site, we will collect your credit or debit card or other financial account information. When you perform a search within the Site, ALF may record information identifying you or linking you to the search performed and recording information related to the search request. We may combine information you submit through the Site with other information we have collected from you, whether online or offline. We treat the combined information in accordance with this Privacy Policy.
b. Sensitive Information
Unless we specifically request or invite it, we ask that you not send or otherwise disclose to us your racial or ethnic origin, political opinions, religion or other beliefs, health, criminal background, or trade union membership. In those cases where we may request or invite you to provide the foregoing information, we will only do so with your express consent, in accordance with applicable data protection law requirements. Where you provide us with such information without request from ALF, we reserve the right (but do not have any obligation) to erase any such information at our discretion.
c. Information About Minors
The Site is not intended for persons under the age of 18. We do not knowingly collect Personal Information online from persons in this age group. We reserve the right to delete any information identified as having been provided by such persons at our discretion.
d. Location Information
Any comment system on the Site may utilize an opt-in Geolocation service in accordance with a prevailing community standard such as HTML 5. Such Geolocation opt-in ability is managed by the user’s browser settings. If a user chooses to opt-in to the Geolocation service, the user’s comments may be associated with the user’s location, both internally within ALF and publicly on the Sites.
e. Passive Information Collection, Use, and Choices
As you navigate the Site, certain Personal Information may be passively collected, meaning it is gathered without your actively providing it. This is done using the following techniques in the following ways:
IP Addresses: An IP address is a unique identifier that certain electronic devices use to identify and communicate with each other on the Internet. When you visit our Site, we may view the IP address of the device you use to connect to the Internet. We use this information to determine the general physical location of the device and understand from what geographic regions our website visitors come. We also may use this information to enhance our Site.
Through your browser: Certain information is collected by most browsers, such as your Media Access Control (MAC) address, computer type and operating system type and version screen resolution, and Internet browser type and version.
Social Media Widgets: Our Site may include social media tools, including social media widgets or plug-ins, to connect you to your social media accounts. Google Analytics: We use Google Analytics, which is provided by Google Inc. On subsequent repeated visits to the Sites, frequently used information is automatically displayed for you. We are able to track your usage patterns with the help of the cookies. The information generated by cookies about the use of the Sites is transmitted to a Google server, which may be located within or outside of, the United States, and stored there. 2. How We Use the Information We Collect
We use Personal Information submitted by you or otherwise collected through the Site and through other sources for the purposes described in this Privacy Policy and as otherwise described to you at the point of collection. Generally, we use the information you provide to us for the reason for which it was provided. For example, if you sign up to receive email notifications, we will contact you by email. If you provide us with information to make a donation, we will use the information to process your donation. Specifically, we may use Personal Information from or about you:
i. to respond to your inquiries and to send you information that you request and to process your donations;
ii. to send you important information regarding our relationship with you or regarding the Site, changes to our terms, conditions, and policies, and other administrative information;
iii. to notify you about upcoming events and donations;
iv. to promote our products and services, and the products and services of our affiliates;
v. for our business purposes, such as data analysis, audits, record keeping, developing new products or services, enhancing the Site, improving our services, identifying Site usage trends, optimizing your experience on the Site, and determining the effectiveness of our fundraising campaigns;
vi. if you choose to complete a survey, we may use the information for purposes of evaluating your feedback from the survey; and
vii. if we intend to collect and use Personal Information for another purpose, we may seek your permission at the time the information is collected.
We may use any information that does not personally identify you, your computer, or your device, for any purpose.
3. Our Disclosure of Your Information
ALF does not sell your Personal Information. We may share your Personal Information with third parties only as described in this Privacy Policy or as otherwise described at the point where we collect the information from you, including:
i. to our affiliates and other American Leadership Forum Silicon Valley organizations for the purposes described in this Privacy Policy;
ii. to the companies or individuals that we hire to provide services to us, such as website hosting services and payment processing; and
iii. to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, or assets (including in connection with any bankruptcy or similar proceedings).
4. Uses and Disclosures to Comply with Laws
In addition, we use and disclose Personal Information collected through the Site as we believe to be necessary or appropriate:
i. under applicable law, including laws outside your country of residence;
ii. to comply with legal process;
iii. to respond to requests from public and government authorities, including public and government authorities outside your country of residence;
iv. to enforce our terms and conditions;
v. to protect our operations or those of any of our affiliates;
vi. to protect our rights, privacy, safety, or property, and/or that of our affiliates, you, or others; and
vii. to allow us to pursue available remedies or limit the damages that we may sustain.
5. Links to Third Party Sites
The Site may contain links to other websites for the convenience of users in locating information, products, or services that may be of interest. If you access a third-party website from a link on this Site, any information you disclose on that website is not subject to this Privacy Policy. It is possible that these links may be used by third parties or others to collect personal or other information about you. ALF is not responsible for the privacy practices of such websites, advertisers, or third parties or the content of such websites and it is your sole obligation to review and understand the privacy practices and policies of these other websites. ALF does not control these third parties’ use of cookies, collection of information, or how they manage such information. It is solely your obligation to review and understand the privacy practices and policies of these other websites, advertisers, and any third parties.
6. Security
ALF will take reasonable steps to protect the information collected and provided via the Site from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, you should understand that no transmission over the Internet is ever fully secure. Also, ALF uses reasonable efforts to ensure that the Site is generally available. However, there will be occasions when access to the Site will be interrupted or unavailable. ALF will use reasonable efforts to minimize such disruption where it is within its reasonable control. You agree that ALF shall not be liable to you for any modification, suspension, or discontinuance of the Site.
7. Data Retention
We generally retain Personal Information for so long as it may be relevant for the purposes identified in this Privacy Policy unless a longer period of time is required by law.
8. Lawful Basis for Processing Your Personal Information
The laws in some countries require us to tell you about the lawful grounds we rely on to collect, use, disclose, and otherwise process your Personal Information. To the extent those laws apply, our lawful bases for processing your Personal Information is in support of our legitimate interests, where those interests are not overridden by your fundamental rights and freedoms. In many cases, we handle Personal Information because it furthers our legitimate business and charitable interests. This includes:
i. providing a safe user experience on our Site;
ii. customer service;
iii. sending communications to you to let you know about what we are doing with your donations and to solicit additional donations;
iv. protecting users, our workers, and our property;
v. analyzing and improving our operations (e.g., optimizing the design and operation of our Site); and
vi. managing legal issues.
This Privacy Policy is issued on behalf of ALF as controller of your Personal Information under applicable data protection laws. A “controller” is the person or organization who alone or jointly determines the purposes for which, and the manner in which, any Personal Information is, or is likely to be, processed.

You can opt-out of the use of certain cookie-related processing by following the instructions in Section 1(e)above (Passive Information Collection, Use, and Choices).
10. Right to Change Privacy Policy
ALF reserves the right at any time to modify, alter, or update this Privacy Policy. Your use of the Site following any changes means that you agree to follow and be bound by the Privacy Policy as changed, subject to limitations under applicable law. Any change to this Privacy Policy shall be effective as to any user who has visited the Site before the change was made. Please review this policy periodically, and especially before you provide any Personal Information to us. The Privacy Policy was last updated on the date indicated above.
